PLEASE READ THIS AGREEMENT CAREFULLY. BY SIGNING, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING A LAWSUIT AGAINST VIHTA SAUNA LLC, EXCEPT AS SPECIFICALLY PROVIDED BY LAW.
In consideration for being permitted to participate in sauna use and related activities provided by Vihta Sauna LLC (“Company”), I, the undersigned participant (“Participant”), on behalf of myself, my heirs, executors, administrators, and assigns, agree as follows:
Acknowledgment of Risks
I understand and acknowledge that the use of a wood-fired sauna and participation in related activities inherently involves both known and unknown risks, dangers, and hazards, which may result in injury, illness, property damage, or death. These risks include, but are not limited to: exposure to extreme heat or cold; dehydration, dizziness, fainting, burns, or aggravation of existing medical conditions; slippery or wet surfaces; collisions or contact with persons or equipment; exposure to airborne illnesses; and defects, malfunctions, or conditions in facilities or equipment. I further understand that injuries may result from emergency response, rescue operations, or actions, inactions, or negligence of others.
Representation of Fitness
I represent and warrant that I am physically and mentally fit to use the sauna. I affirm that I am not pregnant, that I do not suffer from any medical condition that would make sauna use unsafe, and that I am not under the influence of alcohol, drugs, or substances that impair judgment. I have consulted a physician if I have any condition that could be affected by sauna use.
Assumption of Risk and Responsibility
I VOLUNTARILY, KNOWINGLY, AND FREELY ASSUME ALL RISKS OF INJURY, ILLNESS, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY ARISING OUT OF OR RELATED TO MY PARTICIPATION, WHETHER CAUSED BY THE NEGLIGENCE OF THE COMPANY OR OTHERWISE, EXCEPT TO THE EXTENT CAUSED BY GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. I ACCEPT FULL RESPONSIBILITY FOR MY OWN SAFETY AND PROPERTY.
Waiver, Release, and Covenant Not to Sue
TO THE FULLEST EXTENT PERMITTED BY WASHINGTON LAW, I, ON BEHALF OF MYSELF AND ANY MINOR PARTICIPANTS UNDER MY CARE, HEREBY RELEASE, WAIVE, AND DISCHARGE VIHTA SAUNA LLC, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES, FROM ANY AND ALL CLAIMS, DEMANDS, ACTIONS, LIABILITIES, OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH MY PARTICIPATION, INCLUDING CLAIMS BASED ON ORDINARY NEGLIGENCE. I FURTHER COVENANT NOT TO SUE OR BRING ANY ACTION AGAINST THE COMPANY FOR SUCH CLAIMS.
Indemnification
I AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS VIHTA SAUNA LLC, INCLUDING THEIR OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES, FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, DAMAGES, EXPENSES, OR LIABILITIES (INCLUDING ATTORNEY FEES) BROUGHT BY THIRD PARTIES ARISING OUT OF OR RELATED TO MY PARTICIPATION OR MY BREACH OF THIS AGREEMENT.
Medical Authorization and Expenses
I authorize Vihta Sauna LLC to obtain emergency medical care or treatment deemed necessary during my participation. I accept responsibility for all medical expenses incurred, whether covered by insurance or otherwise, and agree that the Company does not assume responsibility for such costs.
Publicity Release
I grant Vihta Sauna LLC the right to use my name, likeness, or image in photographs, video, or other media for marketing or promotional purposes, unless I provide written notice withholding consent.
Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington. Any legal action arising under this Agreement shall be brought exclusively in the state courts of King County, Washington.
Severability
If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be severed, and the remainder of the Agreement shall remain in full force and effect. Nothing herein is intended to waive liability for gross negligence or willful misconduct.
Binding Effect
This Agreement is binding upon me, my heirs, executors, administrators, legal representatives, and assigns, and shall inure to the benefit of Vihta Sauna LLC and its respective successors and assigns.
BY SIGNING THIS AGREEMENT, I ACKNOWLEDGE THAT I HAVE CAREFULLY READ, UNDERSTOOD, AND VOLUNTARILY AGREED TO ALL TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING A LAWSUIT, AND I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.
